Terms & Conditions

1. Definitions

Photographer: Danika Rychter
Client: The individual(s) or entity booking a photography session.
Services: Photography sessions, including family and/or portrait shoots, image editing, and post-production provided by the Photographer.
Deliverables: The final edited digital images and/or prints provided to the Client.

2. Booking and Payment

A non-refundable deposit of 20% of the total session fee is due at the time of booking to secure the session date and time.
The remaining balance is due on the day of the session or as agreed in writing prior to the shoot.
Accepted payment methods include cash, or electronic payment.

3. Session Details and Scheduling

Session date and time will be confirmed upon receipt of the deposit.
Any changes to the scheduled session must be requested at least 48 hours in advance and are subject to Photographer’s availability.
In the event of inclement weather or unforeseen circumstances, the Photographer reserves the right to reschedule the session. If the Client cancels within 48 hours of the session, the deposit will not be refunded.

4. Location and Additional Fees

The standard session fee includes a session held at a mutually agreed, local location.
Additional travel, location permits, or special location fees may apply if the session is outside the agreed-upon area. Such costs will be discussed and agreed upon before the session.

5. Client Cooperation

The Client agrees to follow the Photographer’s guidance during the session to ensure the best possible results.
The Client is responsible for ensuring that any necessary permissions are obtained for shooting on private property.

6. Delivery of Images

Upon completion of the session, the Photographer will provide the edited images within 4 weeks via digital download.
Additional retouching, special edits, or print products may incur extra charges to be agreed upon before production.

7. Copyright and Usage

All images produced during the session remain the sole property of the Photographer.
The Photographer grants the Client a non-exclusive license to use the images for personal, non-commercial purposes.
The Client is not permitted to alter, sell, or commercially use the images without prior written consent from the Photographer.
The Photographer reserves the right to use the images for promotional purposes including portfolio, website, and social media, unless expressly prohibited in writing by the Client.

8. Model Release

By signing these terms, the Client grants the Photographer the right to use the Client’s image(s) for promotional and portfolio purposes.
If a client wishes to restrict certain images from being used, such request must be in writing prior to the session.

9. Limitation of Liability

The Photographer is not liable for any damage, loss, or injury incurred during the session.
In the unlikely event of equipment failure, natural disaster, or other emergency, the Photographer’s liability is limited to a refund of fees paid. No further compensation shall be provided.

10. Cancellation and Rescheduling

If the Client cancels the session after the deposit has been made, the deposit will not be refunded.
Requests to reschedule are subject to the Photographer’s availability.
In the event the Photographer must cancel, the Client will receive a full refund of all monies paid. The Photographer will make every effort to reschedule the session at a mutually agreeable time.

11. Post-Session Collaboration

The Client agrees to provide feedback within 30 days of receiving the images.
Any selection of images, prints, or albums must be made within 14 days to avoid additional handling or archiving fees.

12. Dispute Resolution

Any disputes arising out of these terms and conditions will be subject to mediation, and if necessary, arbitration in accordance with the laws of WA/Australia.
The Client agrees that these terms represent the entire agreement between the Photographer and the Client.

13. Amendments

Any amendments or changes to these terms must be made in writing and signed by both parties.

14. Acceptance of Terms

By booking a session with the Photographer, the Client acknowledges that they have read, understood, and agreed to these Terms and Conditions.
